and it is made available to you on the following conditions. In using,
accessing, or submitting information to CMJ’s web site, this shall
be deemed as acceptance of these terms and conditions. These terms and
conditions may be altered from time to time and the continued use of,
access to or the submitting of information to the web site will be deemed
acceptance of the altered terms and conditions.
Data Protection
As CMJ is committed to confidentiality including all the principals and
obligations of the Data Protection Act 1998 (“DPA”), we strongly
recommend that you also read our Privacy
Policy before registering and using this site.
Copyright & Patent
All copyright and other intellectual property rights in the contents
of this CMJ web site (including design) belong to CMJ and accordingly
all rights are reserved. The only visitors to the CMJ web site that are
permitted to copy, print or download information are those that are registered
with CMJ and are following it’s intended use. The use of this site
does not give anyone proprietary rights in such matters. Patent applied
for.
Site Availability
Our best efforts will be used to ensure that capitalmarket-jobs.com is
available to clients, candidates and graduates 24 hours a day, 7 days
a week. Should however, there is a time when the site is partially or
completely unavailable due to technical faults or reasons beyond our control
such as the risk of an external attack - while we will deal with any such
situation as quickly as reasonably possible - you agree that we shall
have no financial liability to you in the event of this unavailability.
Disclaimer
While CMJ shall use it’s best endeavours to check for and remove
any computer viruses or harmful devices, CMJ does not warrant that the
web site is free of such viruses and harmful devises and accordingly,
CMJ shall not be liable for any loss or damage whatsoever howsoever arising
from them.
Law
These Terms and Conditions shall be governed by and construed in accordance
with English law and the parties submit to the non-exclusive jurisdiction
of the English courts.
Agreement
Once a candidate, graduate or client successfully registers with the
CMJ web site, this will constitute an “Agreement” to follow
the terms and conditions of the site. Failure to adhere to the Agreement
may result in the termination of a registration at any time. The main
provisions governing the usage of the site are detailed below.
Candidates and Graduates (“Candidates”)
CV’s
As the CMJ site is designed to facilitate a seamless recruitment process,
Candidates are required to upload a presentable and accurate CV to their
Profile when registering. While both the provision of the CV and relevance
to the Profile will be checked on registration, any failure to adhere
to this principal at any time thereafter may, with no further notice given,
result in the termination of our Agreement. The use of CV’s and
other personal information supplied by Candidates using the site is governed
by our privacy policy.
Conduct & Confidentially
The Candidates shall not:
- obtain or seek to obtain the details of any Client when the Candidate
has no intention or conceivable prospect of obtaining a position with
that Client; and
- use the web site for the purpose of building up a database of potential
employers (Clients) that that Candidate or any other person intends
to exploit for any commercial purpose
The Candidates acknowledge that the main purpose of this web site is
to facilitate introductions being made between themselves and end employers
(Clients) and that once a CV is requested, it is up to both parties to
agree how to progress matters further. The Candidates confirm to CMJ that
in their dealings with our Clients they shall:
- - act in good faith and in a businesslike and courteous way; and
- - keep strictly confidential all confidential information disclosed
to them
When CMJ are handling a search on behalf of a named Client, the same
conditions of conduct and confidentiality apply.
If upon a complaint and/or investigation CMJ has any reasonable basis
for believing that there has been a breach of the above conditions of
conduct or confidentiality, this shall entitle CMJ to immediately terminate
this Agreement.
The Candidate acknowledges that for expedience during this matching process
(up to and including a Clients response to a downloaded CV), that all
“dialogue” options consists of a multi-choice radio button
format that does not facilitate any free text inclusion. This is the only
format open to both parties and that if any further explanations
were required, they would be subject to that Clients external recruitment
policy and therefore be handled off site.
When CMJ are handling a search on behalf of a named Client, CMJ will be
the point of contact unless you are told otherwise.
Employers (“Clients”)
Use of our Candidate Database
Once registered, using the vacancy/search facilities of your personal
CMJ on-line Profile & CV Management system, you are enabled, via a
registered Candidate Profile to contact our Candidate directly and request
a download of the CV attached to that Profile. Once a CV is downloaded
to the users CMJ Profile & CV Management system and forms the basis
of a short-list you may:
- only download it onto your own database for the purposes of finding
a suitable Candidate for a current vacancy you wish to fill.
- use the information about the individual(s) contained in the CV (‘s)
for the purposes of contacting them in relation to a specific job vacancy.
- use the information only in connection with your own recruitment-related
activities.
You must, at all times, comply with the Data Protection Act 1998 and
all subsequent legislation and regulations.
You agree to deal with the Candidates on our database in strict confidentiality
and in a professional manner that will not bring CMJ into disrepute. You
will indemnify CMJ from and against any claim brought by a Candidate against
CMJ arising from your breach of this obligation or any other of these
terms and conditions.
Business Terms
Level 1
Upon payment for a minimum term of three months (calculated as 90 consecutive
days), using a precise skill-set search, match and sort system, registered
Clients can access as many Candidate Profiles and request as many CV’s
resulting from them as they like.
Renewal reminders will be sent by email via our on-line accounts system,
but due to the unrestricted access given to our Candidate database, unless
the quarterly period is renewed prior to the 90th day anniversary, that
access will automatically expire. In this event, we would not be responsible
for any loss of previously compiled data.
Level 2. (optional)
As above, but on an individual, departmental or company wide basis, should
a Client require a more traditional search and short listing service -
based only on a successful placement - CMJ will then issue an invoice
for this addition service.
This fixed fee is very competitive and based on a percentage of the Candidates
starting basic salary, not remunerative package. This consultancy
service is currently only available to clients engaged in the recruitment
of experienced market professionals and not those conducting a graduate
search or recruitment programme.
Value Added Tax, where applicable, shall be paid by the Client at the
time and in the manner prescribed by law.

Posting Vacancies
The Client may use the systems software to create and edit an unlimited
amount of vacancies within the designated registration period.
Once a master password is issued to a Client, the Client takes full responsibility
for any person (whether or not authorised by the Client) who uses the
Clients user name and password to access the vacancy listings and Candidate
data. This applies to the master password and any additional users allocated
from the master internally.
While CMJ’s web site shall use all reasonable endeavours to locate
job seekers suitable for client vacancies through its software, CMJ accepts
no responsibility for the failure of it’s software to find suitable
CV’s.
